A Los Angeles judge denied Dear request a guardianship control his son's finances, Elie Bleu Allman.
Los Angeles Superior Court Judge Jessica A. Uzcategui ruled that the singer's attorneys failed to provide Allman and his lawyers with necessary documents to give them enough time to argue their case. Uzcategui scheduled another hearing for January 29, according to the Associated Press.
The Grammy-winning artist filed the request last week out of concern for Allman, 47, alleging that he is “substantially incapable of managing his own financial resources due to serious mental health and substance abuse issues”, according to reports. She added that she feared her son would spend money from his trust fund on medications that would put his “life at risk.”
Allman, the child of “Believe” singer and famous rocker Gregg Allman, is currently entitled to regular financial distributions from a trust established by his father, who died in 2017.
In court Friday, Uzcategui said she wasn't convinced by Cher's argument.
Uzcategui cited the refusal of Cher's lawyers to share documents with Allman's lawyers when contacted Thursday, AP reported. Cher's lawyers said they had privacy concerns and instead shared the documents with Allman's court-appointed attorney.
Allman said in a court filing before the hearing that a conservatorship was not necessary. He acknowledged that he suffered from addiction and irresponsible spending, but said he was under a doctor's care, had been sober for more than three months, attended Alcoholics Anonymous meetings and that he was willing to submit to drug testing.
“While I understand that my mother, the proposed conservator, believes she is looking out for my best interests and I appreciate her love and support, I do not need her unsolicited help or support for the moment,” the filing states.
Cher's request also sought to deny Allman's ex-wife, Marieangela King, any control over her son's assets. Documents claim King is unfit to serve as Allman's conservator because the couple's “tumultuous relationship was marked by a cycle of substance abuse and mental health crises.” People reported.
King previously accused Cher of kidnapping his son in November 2022 from a New York hotel where he was with his wife as they celebrated their anniversary. Dear denied the qualification of “kidnapping”.
In court documents reviewed by The Times, King said that on the night of the couple's anniversary, four men “came to our hotel room and took (Allman) out of our room.”
Allman and King married in 2013. He filed for divorce in November 2021, but a year later the couple spent nearly two weeks in a New York hotel trying to repair their marriage, according to court documents.
In documents filed by King shortly after the alleged kidnapping incident, she said: “I am currently unaware of my husband's medical condition or whereabouts. I am very worried and concerned for him. One of the four men who took him told me they were hired by (Allman’s) mother,” referring to Cher.
The king deposed a separate motion in October, alleging that Cher kept her son's whereabouts a secret and interfered with his health treatment.
The primary purpose of King's filing was to obtain spousal support and other supports, such as housing and health care, as well as access to his own property, such as their car and other valuables, and to tax documents to prepare for a possible divorce trial, King's attorney said in the filing. King said in the documents that Allman owed him $40,000 in spousal support.
