Oh Federal Regional Court of the 1st Região (TRF-1) proposes to the National Agency for Land Transport (ANTT) to learn viagens feitas pela Buser and other bus freight companies nationwide. For Judge Mateus Pontalti, of the 13th federal region of the Seção Judiciária of the Federal District, this is a type of clandestine activity.
The latter's decision, based on Súmula nº 11, considers illegal vehicles as vehicles that do not have any type of authorization. The magistrate confirmed that:
The term “clandestine” has a specific meaning in legal vocabulary: an activity carried out without any authorization. When there is a license that is not entirely adequate for the activity in question, it is not possible to go underground.
Giovani Ravagnani is Buser's Legal and Compliance Director, and also comments on the situation:
This decision represents an important recognition of technological paper in the context of passenger transport, which allows the creation of new models such as the intermediary of passengers without freight. Buser continues to compromise by offering innovative and efficient solutions to users, always guaranteeing the security and legality of its operations.
Persecution scenario and favorable decisions
It is important to emphasize that this new life is more of a chapter in the story that Buser made with the questions posed by the ANTT and his taxes. Separately, a startup is seeking to obtain cargo licenses from various tourism companies. In 2023, 12 group companies, or 60 fretadoras, are stationed at the agency.
On the other hand, Buser decided in his favor, for the release of his operations in the state of Paraná not a year ago. Likewise, a decision of the TRF-6 confirms the legality of the company's operations. The TRF-5, for its part, decided to suspend the cassation of a bus parcel in the Nordeste.
